These Terms & Conditions (“Terms”) govern your use of our website (aquacleaningnc.com) and any request for, booking of, or payment for services provided by Aqua Cleaning (“Aqua Cleaning,” “Company,” “we,” “us,” “our”). By accessing our website, submitting a form, requesting a quote, scheduling service, or allowing us to perform services at your property, you agree to these Terms.
Services Covered
We provide exterior and/or interior window cleaning, pressure washing, soft washing (house washing and/or roof washing), gutter cleaning, and related add-on services such as track detailing, screen cleaning, and solar panel cleaning (collectively, “Services”). The exact scope for your job is defined by your estimate, invoice, work order, or written agreement.
Estimates, Scope Changes, and Final Price
• Estimates may be provided in writing, by phone/text/email, or in-person.
• Pricing may be based on information you provide (photos, measurements, access details, visible condition). If site conditions differ from what was represented (additional windows, heavy buildup, hard water stains, accessibility issues, required ladder work, safety hazards, etc.), we may revise the price or scope before or during service.
• Additional services requested on-site are subject to additional charges.
Scheduling, Arrival Windows, and Rescheduling
• Appointment times are estimates. We may provide an arrival window.
• We may reschedule due to weather, equipment issues, emergencies, or unsafe conditions.
• If we reschedule, we will communicate as soon as reasonably possible.
Cancellations / No-Show Policy
• You may cancel or reschedule by contacting us as early as possible.
• Late cancellations or no-shows may be subject to a fee to cover crew time and travel (especially for multi-employee setups), unless prohibited by law or otherwise stated in writing.
• If we arrive and cannot access the property or complete work due to issues outside our control (locked gates, pets not secured, no water access, etc.), a trip fee may apply.
Customer Responsibilities (Access, Utilities, Safety)
You agree to:
• Provide safe, unobstructed access to the areas to be serviced (including unlocking gates, moving items as needed, and providing entry for interior work if purchased).
• Secure pets and inform us of any hazards (aggressive animals, unstable ground, electrical issues, wasp nests, fragile landscaping, etc.).
• Ensure exterior water supply is available and functioning for services requiring water.
• Ensure exterior power access is available if required for equipment.
• Remove or secure fragile items near work areas (potted plants, décor, etc.).
• Inform us of any known issues (leaks, broken seals, cracked glass, rotting wood, loose fixtures, oxidized paint, damaged siding, etc.) before service.
Pre-Existing Conditions and Property Risk Disclosures
Window & Glass:
• Many windows have pre-existing issues that are not visible until cleaning (failed seals, oxidation, etching, cracked glass, brittle screens, deteriorated caulk, loose panes).
• We are not responsible for damage due to pre-existing conditions, defective installation, or normal aging/wear.
Pressure Washing / Soft Washing / Roof Washing:
• Exterior surfaces can have pre-existing deterioration (oxidation, loose paint, soft/rotted wood, failing mortar, loose siding, improper caulking, poorly sealed windows/doors).
• We use professional methods designed to reduce risk; however, we are not responsible for damage caused by pre-existing defects, improper installation, or materials that cannot withstand cleaning.
• Roof washing results vary depending on roof age, type, and condition. We do not guarantee removal of all stains or organic growth if the surface is degraded or if conditions make full removal unsafe.
Gutters:
• Gutters may contain debris, rust, rot, loose fasteners, improper pitch, or failing seals. We are not responsible for pre-existing leaks, interior water intrusion, or damage due to aged/defective gutter systems.
Solar Panels:
• Solar panels and mounts can be fragile or improperly installed. We use low-risk cleaning methods; we are not responsible for pre-existing panel defects, wiring issues, or installation flaws.
Results and Satisfaction
• We aim for professional-quality results. Some staining, etching, hard water spots, paint overspray, oxidation, or permanent surface damage may not be fully removable with standard cleaning.
• If you have a concern, notify us within 72 hours of service completion so we can evaluate and, if appropriate, address the issue. Re-cleaning (if offered) is limited to the originally serviced areas.
Photos, Documentation, and Communication
• We may take before/after photos or videos for documentation, quality control, training, or marketing. We will avoid personally identifying details whenever reasonably possible. If you do not want your property used in marketing, tell us in writing before service.
• Communications may occur via phone, email, and text message.
Payment Terms
• Payment is due upon completion unless otherwise agreed in writing.
• We accept approved payment methods communicated at booking/invoice.
• Late payments may be subject to fees and/or collection costs as permitted by law.
Service Plans / Memberships (if applicable)
If you purchase a recurring service plan:
• Plan terms (frequency, discounts, included services, and renewal/cancellation rules) are defined in your plan agreement or invoice terms.
• If a plan discount was applied and you cancel early, you may be responsible for repaying discounted amounts or paying the standard retail difference, if disclosed at purchase.
SMS / Text Messaging Terms
If you opt in to receive SMS messages from Aqua Cleaning:
• You may receive messages related to quotes, scheduling, confirmations, on-the-way updates, service reminders, review requests, and occasional promotions. Message frequency may vary.
• Message & data rates may apply.
• You can opt out at any time by replying STOP. Reply HELP for assistance.
• Consent to receive texts is not a condition of purchase.
• Carriers are not liable for delayed or undelivered messages.
Intellectual Property
All website content, logos, graphics, text, and branding are owned by Aqua Cleaning and may not be copied or used without written permission.
Third-Party Links
Our website may link to third-party platforms (e.g., Google, Instagram, Yelp). We are not responsible for their content or practices.
Disclaimer of Warranties
Our website and Services are provided “AS IS” and “AS AVAILABLE.” We do not make warranties regarding uninterrupted website operation or perfect results in all circumstances.
Limitation of Liability
To the fullest extent permitted by law:

Aqua Cleaning is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages (including lost profits, lost use, or inconvenience), even if advised of the possibility.

We are not responsible for damage caused by pre-existing conditions, defective installation, manufacturer defects, or normal wear and tear, even if such issues become visible during or after cleaning.
Service-fee cap for most claims:
For claims not involving direct physical property damage caused by our negligence, our total liability for any claim related to the Services will not exceed the amount paid for the specific Service giving rise to the claim.
Direct property damage caused by our negligence:
If direct physical property damage is proven to have been caused by Aqua Cleaning’s negligence, our responsibility will be limited to the reasonable cost to repair the damaged portion (or replacement of the damaged component, if repair is not feasible), as determined by Aqua Cleaning in good faith and/or our insurance carrier, and subject to the limitations in these Terms (including pre-existing conditions and material defects).
No limitation where prohibited:
Some limitations may not apply in jurisdictions that do not allow certain exclusions or limitations, and nothing in these Terms limits liability for gross negligence or willful misconduct where such limitation is prohibited by law.
Indemnification
You agree to defend and indemnify Aqua Cleaning from claims arising out of your breach of these Terms, unsafe conditions at your property not disclosed to us, or your misuse of the website.
Governing Law; Venue
These Terms are governed by North Carolina law. Any dispute will be brought in a court of competent jurisdiction in or nearest to Durham County, North Carolina, unless otherwise required by law.
Sever-ability
If any provision is found unenforceable, the remaining provisions remain in effect.
Updates to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new “Last Updated” date. Continued use of our website or Services after updates constitutes acceptance.
